Sri Lankan batter Danushka Gunathilaka has been granted bail while awaiting trial on charges of sexual intercourse without the victim’s consent. He received bail with an AUD 150,000 surety & terms of not using Tinder or any other dating apps. Notably, he is also prevented from accessing his existing social media accounts unless he is in the company of his legal team.
Danushka Gunathilaka was arrested in the early hours of November 6 at Sydney’s Hyatt Regency Hotel where he was staying while the entire Sri Lanka squad for the T20 World Cup was staying in Australia. He is facing four counts of sexual intercourse without consent & hasn’t given a plea yet.
Magistrate Janet Wahlquist granted him bail on Thursday in Sydney’s Downing Center Local Court. He appeared in the court via an audiovisual link from Parklea Jail. Though Police Prosecutor Kerry-Ann McKinnon was opposing his bail stating that Gunathilaka could endanger the safety of the complainant. However, magistrate Wahlquist has taken into account how bail would have been approached if Gunathilaka was an Australian Citizen facing the same charges.
A police facts sheet filed in the court read, “the victim tried to remove the accused’s hand by grabbing his wrist but the accused squeezed her tighter around her neck. As a result, the victim due to the fear of her life couldn’t get away from the accused.”
Danushka receives bail on certain terms & conditions
During Police Investigation Gunathilaka supported some of the victim’s statements but completely denied that he was violent or consent was not given for sexual intercourse. Thangaraj Gunathilaka’s SC said that Gunathilaka has co-operated with the investigating officers & surrendered his passport.
Though Danushka Gunathilaka has received bail he would be required to live at a specific address & report to the police daily. As per the complaint filed by the victim, Gunathilaka & victim met each other on Tinder & later for a date before the Sri Lankan batter visited her residence where he refused to have sexual intercourse with protection & choked her three times. The Popular Sri Lankan batter was also a part of Sri Lanka’s T20 World Cup Squad but could play just one game for them before being ruled out of the tournament due to a hamstring tear. Gunathilaka will return to court on January 12 for further proceedings.
